Terms for using the event apps

1. Agreement and operator

These Terms of Use form an agreement between you and Xcape Reality Private Limited ("Xcape", "we", "us", or "our") concerning your use of the relevant invite-only T&P Connections Tour app and its event services. By accessing an app, you agree to these terms and our Privacy Policy. If you do not agree, do not use the app.

Any app-store terms that apply to your download also continue to apply. If those terms conflict with these terms, the app-store terms control to the extent required by that store or applicable law.

2. Eligibility and event access

The apps are intended for invited adult attendees, speakers, sponsors, staff, and authorised event personnel. You must use the official email address or access method approved for your invitation and provide accurate information. An invitation is personal and may not be transferred. Event admission, schedules, capacity, sessions, benefits, and availability remain subject to the organiser's rules and may change.

3. Account security

You are responsible for protecting your device, one-time codes, QR credentials, and account access. Do not share authentication codes or allow another person to impersonate you. Notify support promptly if you suspect unauthorised use. We may require re-verification and may suspend access to protect users or the event.

4. Licence and acceptable use

We grant you a limited, revocable, non-exclusive, non-transferable licence to use the app for the relevant event and your authorised role. You must not:

• copy, sell, sublicense, reverse engineer, probe, disrupt, or misuse the app except where applicable law expressly permits;
• bypass access controls, forge QR credentials, automate scans, manipulate points or attendance, or interfere with another user's account;
• upload malware, scrape attendee information, harvest contacts, or use app information for unsolicited marketing;
• post unlawful, abusive, discriminatory, misleading, infringing, or privacy-invasive content; or
• use the app in a way that violates law, event rules, venue rules, or another person's rights.

5. QR, networking, and event features

Your QR credential is event-bound and is used only for authorised event operations. Verified server records determine entry, attendance, passport progress, capacity, and any approved points or benefits. Pending offline actions may require synchronisation and review. Points, rankings, access, benefits, and feature availability are not cash, cannot be transferred, and may be corrected where records are duplicated, invalid, or erroneous.

Networking features share profile information according to the connection and privacy choices shown in the app. You are responsible for your conversations and for how you use information another attendee chooses to share.

6. Your content and moderation

You retain ownership of content you submit. You grant Xcape and the event organiser a limited licence to host, process, display, and moderate that content solely to operate, secure, and support the event and app. You confirm that you have the rights needed to submit it.

We may remove content, restrict messaging, preserve evidence, or suspend accounts when reasonably necessary to enforce these terms, address reports, protect safety, or comply with law. Reporting and blocking tools are not emergency services.

7. Third-party content and services

The app may show organiser-supplied information or link to services such as Slido, map, calendar, app-store, or browser features. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party content, availability, or acts, except to the extent the law does not allow that responsibility to be excluded.

8. Ownership

The app software, design, and Xcape-provided materials are owned by Xcape or its licensors. Event names, client marks, speaker materials, sponsor content, and other third-party materials belong to their respective owners. No rights are granted except the limited right to use the app under these terms.

9. Availability and changes

We aim to provide a reliable service, including reasonable offline recovery, but event connectivity and mobile platforms can be unpredictable. Features, schedules, content, and access may be changed, paused, or discontinued for operational, security, legal, or event reasons. Keep the app updated when a compatible update is required.

10. Disclaimers and liability

The app is provided on an "as available" basis. To the maximum extent permitted by law, we disclaim implied warranties that cannot reasonably apply to this event service. We do not guarantee uninterrupted access, error-free content, event outcomes, business opportunities, or preservation of unsynchronised device data.

To the maximum extent permitted by law, Xcape is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss caused by unauthorised use, third-party services, venue conditions, or matters outside our reasonable control. Nothing in these terms excludes liability that cannot legally be excluded or limits your mandatory consumer rights.

11. Suspension, termination, and deletion

You may stop using the app at any time and may request account deletion through our deletion page. We may suspend or terminate access for material breach, risk to users or systems, withdrawal of event eligibility, legal requirements, or when the event service ends. Sections that by their nature should survive termination—including ownership, lawful retention, disclaimers, and dispute provisions—will survive.

12. Governing law

These terms are governed by the laws of India, without limiting any mandatory rights you have under the law applicable to you. Courts with competent jurisdiction in India will have jurisdiction over disputes, unless applicable law requires another forum. Before filing a claim, please contact us so we can try to resolve the issue informally.

13. Changes

We may update these terms to reflect service, event, security, or legal changes. The updated version and effective date will be posted here. Where required, we will provide additional notice or seek renewed agreement.
